When the driver flees

Michigan hit-and-run accident lawyer

The driver fled, but you still have options. Here’s how to protect your claim and who pays your bills.

Being hit by a driver who flees is frightening and infuriating, and it raises an immediate question: who pays? In Michigan, you still have options, but acting quickly matters.

What to do right away

  1. Call 911 and get medical care.
  2. Report the crash to police immediately. A prompt police report is important, and many insurance policies require one for hit-and-run claims.
  3. Write down everything you remember: the vehicle’s color, make, damage, direction of travel and any part of the license plate.
  4. Look for witnesses and cameras. Nearby businesses, homes and traffic cameras may have footage, but it is often recorded over within days.
  5. Notify your own auto insurer promptly. Uninsured motorist claims often have strict notice requirements.

Who pays your medical bills

Your no-fault PIP benefits generally pay your medical bills and a portion of lost wages no matter who caused the crash, including in a hit-and-run. If you have no auto insurance and no household policy applies, you may be able to apply through the Michigan Assigned Claims Plan. Learn about PIP benefits.

Recovering for pain and suffering

Because the at-fault driver is unknown, a pain and suffering claim usually depends on your own uninsured motorist (UM) coverage. UM coverage is optional in Michigan, and its terms vary. Many policies require physical contact with the other vehicle and prompt reporting to police and the insurer. We review your policy carefully. Learn about uninsured motorist coverage.

If the driver is found

If police identify the driver, you may have a claim against that driver and their insurer, just as in any other crash. Leaving the scene of an injury crash can also lead to criminal charges against the driver, which is separate from your injury claim.

Frequently asked questions

Will my insurance cover a hit-and-run?

Your no-fault PIP benefits generally still pay your medical bills and a portion of lost wages. Whether you can recover more, such as pain and suffering, usually depends on whether you have uninsured motorist coverage and on its terms.

What if police never find the driver?

You may still be able to recover through your own coverage. If the driver is later identified, you may also have a claim against that driver and their insurer.
